OpenAI finds itself embroiled in yet another privacy quandary as a fresh General Data Protection Regulation (GDPR) complaint surfaces against its AI chatbot, ChatGPT, within the European Union (YahooFinance). Filed by Vienna-based privacy rights nonprofit noyb (None Of Your Business) on behalf of an individual complainant, the grievance revolves around ChatGPT’s inability to rectify misinformation it generates about individuals (TechCrunch).
Transparency Concerns and Legal Ramifications
According to NOYB, OpenAI has acknowledged its inability to correct inaccuracies produced by ChatGPT and has not provided clarity on the sources of data used or stored by the AI tool. The group highlights instances where ChatGPT allegedly provided incorrect information about individuals, including NOYB founder Max Schrems. OpenAI reportedly refused Schrems’s requests to rectify or delete the inaccurate data, prompting NOYB to take action.
In response to these allegations, OpenAI emphasised its commitment to data privacy and stated that its AI models are designed to learn about the world, not individuals. However, NOYB remains steadfast in its criticism and is urging Austria’s data protection authority to investigate and potentially fine OpenAI for non-compliance with EU law.
